Ecuador is responsible for violating the rights to personal liberty and due process of three individuals subjected to criminal proceedings

 

San José, Costa Rica, January 23, 2025. In the judgment in the case of Reyes Mantilla et al. v. Ecuador, notified today, the Inter-American Court of Human Rights declared that the State of Ecuador is internationally responsible for the illegal and arbitrary detention of Walter Ernesto Reyes Mantilla, Vicente Hipólito Arce Ronquillo and José Frank Serrano Barrera, the victims. Moreover, it determined that the preventive detention measures applied to them entailed a violation of the rights to personal liberty, presumption of innocence, equal protection and non-discrimination. It also concluded that there was a violation of the rights to judicial guarantees and judicial protection in the criminal proceedings against them and determined that they were victims of inhumane and degrading treatment due to the aggressions and threats during the time that they were detained.

  • I/A Court HR declares that the American Convention continues to be in effect in Venezuela and it has jurisdiction to continue hearing the case of Chirinos Salamanca et. Al. V. Venezuela

    San José, Costa Rica, August 26, 2025. The Inter-American Court of Human Rights (I/A Court HR) issued a judgment on the preliminary objections in the case of Chirinos Salamanca et al. v. Venezuela on August 21, 2025. The Court unanimously rejected the preliminary objections filed by the State in its response to petition, regarding the alleged lack of jurisdiction ratione voluntatis and ratione temporis, and the control over lawfulness of the actions of the Inter-American Commission. Consequently, the Court will continue hearing the case in the merits stage and subsequent reparations and costs.

  • The Inter-American Court of Human Rights recognizes the existence of a stand-alone human right to care

    San José, Costa Rica, August 7, 2025. The Inter-American Court of Human Rights notified today Advisory Opinion 31 of 2025 on the content and scope of care as a human right and its interrelationship with other rights, adopted on June 12, 2025, in response to a request submitted by the Republic of Argentina in January of 2023. This advisory process had the second highest participation in the Court’s history, with a total of 129 observations received, and it was the first in which an international court was asked to address the right to care.

  • Chile complied with the judgment in the Case of Teachers of Chañaral and other Municipalities
