  • Publication of the Jurisprudence Journal of the Inter-American Court of Human Rights no. 42: the Human Rights of persons with disabilities

    San José, Costa Rica, April 25, 2025.-?The Inter-American Court of Human Rights is pleased to announce the publication of the new jurisprudence journal, which addresses general aspects of disabilities that allow clarifying the bases from which jurisprudence of the Inter-American Court is developed, treats conceptual and regulatory aspects, the situation of vulnerability often experienced by persons with disability, the social model as basis of analysis and the consequences of State obligations.??

    San José, Costa Rica, abril 22 de 2025— Hoy la Corte Interamericana de Derechos Humanos, Conamaj y la Fundación Paniamor presentaron la Convención Americana sobre Derechos Humanos interpretada e ilustrada por y para niños, niñas y adolescentes de América Latina y el Caribe, en la sede de la Corte Suprema de Justicia de Costa Rica. Un esfuerzo colaborativo que concluyó en un documento enriquecedor desde la perspectiva de la niñez y las adolescencias.

  • For the First Time, the I/A Court H.R. Rules on the Scope of the Rights of Indigenous Peoples in Voluntary Isolation in the Case of The Tagaeri and Taromenane Peoples Vs. Ecuador

    San José, Costa Rica, March 13, 2025. In the ruling, notified today, in the case of the Indigenous Peoples Tagaeri and Taromenane vs. Ecuador, the Inter-American Court of Human Rights declared the international responsibility of the State of Ecuador for violations of the rights to collective property, self-determination, a dignified life, health, food, cultural identity, a healthy environment, housing, life, judicial guarantees, and judicial protection to the detriment of the Tagaeri and Taromenane Peoples and other Indigenous Peoples in voluntary isolation ("PIAV") inhabiting the western Ecuadorian Amazon Forrest. Additionally, it declared state responsibility for violations of the rights to personal integrity, personal freedom, honor, dignity, protection of the family, childhood, identity, mobility and residence, cultural identity, health, and judicial guarantees to the detriment of two girls from these peoples at the time of the events.

  • Brasil es responsable por incumplir su obligación de proteger los derechos de las comunidades quilombolas de Alcântara

    San José, Costa Rica, 13 de marzo de 2025. En la sentencia notificada hoy en el caso Comunidades Quilombolas de Alcântara Vs. Brasil, la Corte Interamericana de Derechos Humanos – Corte IDH declaró responsable internacionalmente al Estado de Brasil por violaciones a los derechos humanos de 171 comunidades quilombolas ubicadas en el municipio de Alcântara, Maranhão, por diversas afectaciones a su derecho a la propiedad comunal así como por la afectación de otros derechos. Concretamente, la Corte declaró la violación de los derechos a la propiedad colectiva, a la libre circulación y residencia, a la libre determinación, a la consulta previa, libre e informada, afectaciones al proyecto de vida colectivo, violación a los derechos a la protección a la familia, a la alimentación y vivienda adecuadas, a la educación, a la igualdad ante la ley, a la prohibición de discriminar con base en la raza y la posición socioeconómica, a las garantías judiciales y a la protección judicial, en perjuicio de las Comunidades Quilombolas de Alcântara.

  • Brasil es responsable por la desaparición forzada de un trabajador rural y un defensor de los derechos humanos

    American Court of Human Rights (I/A Court HR) found the State of Brazil internationally responsible in the case of Muniz da Silva et al. v. Brazil, for the forced disappearance of Almir Muniz da Silva, rural worker and human rights defender of the rural workers in the state of Paraíba. Moreover, it declared the responsibility of the State for the lack of due diligence in the investigation of the facts and search for the victim, as well as the violation of the rights to the truth, to defend human rights, personal integrity, rights of the family and rights of the child. Consequently, the Court determined the violation of Articles 3, 4(1), 5(1), 7(1), 8(1), 13, 16(1), 17, 19 and 25(1) of the American Convention, in relation to Articles 1(1) and 2 thereof.

  • The President of the Inter-American Court of Human Rights: “When the State does not act with due diligence when there is a complaint or suspicion of gender violence it becomes an accomplice to discrimination and impunity”

  • Nicaragua es responsable internacionalmente por la falta de debida diligencia reforzada en la investigación de una muerte potencialmente ilícita con indicios de feminicidio

    San José, Costa Rica, March 4, 2025. In the judgment in the case of Carrión González et al. v. Nicaragua, notified today, the Inter-American Court of Human Rights declared the State of Nicaragua internationally responsible for the lack of due diligence and gender perspective in the criminal investigation into the potentially unlawful death, with indications of femicide, of Dina Alexandra Carrión González; the lack of due diligence in the proceedings regarding contact between Dina Alexandra Carrión González’s son and his maternal grandparents; the lack of investigation into the threats received by one of Dina Alexandra’s sisters, allegedly related to her promoting the investigation of the facts; and the impact of the impunity on the next of kin of Ms. Carrión González.

  • Ecuador es responsable por violación a la obligación de informar del derecho a solicitar asistencia consular

    San José, Costa Rica, marzo 3 de 2025. En la sentencia, notificada hoy, en el caso Gattass Sahih Vs. Ecuador, la Corte Interamericana de Derechos Humanos declaró la responsabilidad internacional del Estado de Ecuador por la violación al derecho a la información sobre la asistencia consular, en perjuicio de Elías Gattass Sahih. Tal violación derivó de la omisión por parte del Estado de informar, en la etapa procesal correspondiente, al señor Gattass Sahih de su derecho a solicitar asistencia consular.

Brasil, por la falta de debida diligencia reforzada en la investigación de la violación del derecho a la igualdad y la no discriminación por razón de raza y color sufrida por Neusa dos Santos Nascimento y Gisele Ana Ferreira Gomes.

  • Brazil is responsible for the lack of due diligence and violation of the right to the truth in the investigation of the murder of a rural worker

    San José, Costa Rica, February 18, 2025. - In the judgment notified today, the Inter-American Court of Human Rights (I/A Court HR) found the State of Brazil internationally responsible in the case of Da Silva et al. v. Brazil for the lack of due diligence and the violation of the guarantee to a reasonable term in the criminal proceedings initiated regarding the murder of Manoel Luiz da Silva in 1997. The Court declared the State internationally responsible for the violation of the rights to the truth and personal integrity to the detriment of the victim’s next of kin.

  • Chile is internationally responsible for the death of 10 adolescents in a fire at a detention center and the detention conditions of 271 adolescents held in four facilities run by the National Children’s Service

    San José, Costa Rica, February 18, 2025. In the judgment in the case of Adolescents Held in Short- and Long-term Detention Facilities run by the National Children's Service (SENAME) v. Chile, notified today, the Inter-American Court of Human Rights declared the international responsibility of the Republic of Chile for the violation of the right to life, right to personal integrity and rights of the child to the detriment of 10 adolescents who died in a fire on October 21, 2007, at the short-term detention center “Tiempo de Crecer” in Puerto Montt and the violation of the right to personal integrity of their next of kin. It also found the State responsible for the violation of several rights of 271 adolescents that were held, during different periods between 2006 and 2009, at the short- and long-term detention facilities Lihuén, Antuhue, San Bernardo, and “Tiempo de Crecer” managed by SENAME, due to the conditions of their detention.

  • Ecuador es responsable por actos de tortura que causaron la muerte de una persona detenida

    San José, Costa Rica, febrero 11 de 2025. En la sentencia del caso Aguas Acosta y otros Vs. Ecuador, notificada hoy, la Corte Interamericana de Derechos Humanos declaró que el Estado del Ecuador es responsable internacionalmente por los hechos de tortura que resultaron en la muerte de Aníbal Alonso Aguas Acosta. Asimismo, la Corte determinó la violación de diversos derechos en perjuicio de los familiares del señor Aguas Acosta.
